At 2Costa Rica Real Estate, we maintain the highest standards for our procedures and have a network of specialists who are all involved in real estate. Many risks could be taken in international investments, and as professionals, we recognize the importance of getting everything in order before encountering any further problems along the way. Escrows are essential in Costa Rica real estate to ensure that both the buyer and the seller have secure investments. This necessity for security is why we've worked with TLA Escrow for the majority of our transactions and is our preferred service for escrow accounts.

What Is an Escrow Account in Costa Rica?
Escrow is the neutral mediator between the buyer and the seller in a property deal. This neutral middle step between both parties in the Costa Rica real estate market was born out of a necessity for having secured straightforward processes that represent both parties in any transaction.
How Does an Escrow Account Work?
Escrow Transactions follow straightforward steps:
- The buyer deposits funds into a secure, neutral account.
- The seller agrees to transfer the property under agreed conditions.
- The Escrow Company or service holds the money and only releases it when all the agreed conditions are met.
Part of why the processes are so straightforward is that the seller is not handing a property without the reassurance that the forms are real and ready to be deposited. The buyer, at the same time, doesn't risk wiring hundreds of thousands of dollars directly to someone they barely know and a jurisdiction that is not their own country, so it allows them security and peace of mind that whatever they are wiring is protected.
For foreign buyers in Costa Rica, especially from the US and Canada, the escrow process brings a familiar and safe structure they already know to a market that still needs to formalize its systems and regulations.
Why Escrow Matters in Costa Rica and Latin America
In real estate markets that attract jungle luxury residence investors and second-home buyers, such as Costa Rica, escrow services are essential for navigating the market's distinctive nuances. Given the significant foreign interest, rising prices, and frequent cross border transactions, often involving parties unfamiliar with local laws, a structured and trustworthy process like escrow is required.
Costa Rica, a leading investment destination, is undergoing new and strong regulatory development. This growing environment needs more rules, infrastructure, and processes for dealing with the issues that arise during growth. Escrow providers play an important role in this by creating predictable, systematic, and standardized processes in the property buying and selling process.
At 2Costa Rica Real Estate, we consider using professional escrow accounts not as an option, but as an absolute necessity. In this real estate environment, a regulated and professional escrow service works as necessary risk management.

Step by Step: How the Escrow Process Works in a Costa Rica Property Transaction
Step 1: Deal Agreed
Buyer and seller agree on price and basic terms, usually with the help of a real estate agent and legal representation.
Step 2: Escrow Is Opened
An agent, attorney, or closing coordinator contacts the escrow company. The escrow company opens an account, often within the same day.
Step 3: KYC and AML Compliance (Know Your Client)
Both parties must provide KYC (Know Your Client) information and anti money laundering (AML) documentation that requires the following:
- Identification documents
- Source of funds documentation
- Completed AML forms
This step has become significantly more robust in recent years as AML regulations have tightened globally and locally.
Step 4: Funds Are Deposited into Escrow
The buyer wires money to the escrow account, never directly to the seller. The escrow company confirms receipt and holds the funds under the conditions outlined in the escrow agreement.
Step 5: Conditions Are Verified
The legal team, in coordination with the escrow company, checks:
- Title status
- Liens or encumbrances
- Required permits or documentation as applicable
- Any contractual conditions, such as inspections, repairs, and approvals, are handled.
Step 6: Closing and Disbursing Funds
Once all conditions are satisfied, the escrow company releases funds according to the closing statement to the seller, to the existing liens, and any other closing costs, commissions, or fees. Escrow accounts ensure that no funds are moved until all the requirements are in check and in compliance with the agreements made in the deal.
Escrow vs. Title Insurance in Costa Rica: What's the Difference?
Real estate transactions in Costa Rica are different from those in the US with regard to both financing methods and title insurance policies. First of all, while most real estate transactions in the US are mortgage transactions where a significant part of the funds required for purchase is provided by banks through issuing loans to the buyer, almost all of the transactions in Costa Rica are done with cash payments, and buyers rarely use mortgage funds from local banks.
As a result of the difference in financing practices, in Costa Rica, there is no need for title insurance, which is mandatory in the US since banks require it in order to cover themselves in case something is not compliant with the terms agreed on the deal. Title insurance is optional, more likely to be used when there is a lender, a US financing method, a high value transaction, or a buyer who wants more protection on their investment.

Escrow handles the transaction process, and funds and title insurance cover legal history risk and the investiment's future. They are complementary, not subtitutes.
Escrow Strengthens the Costa Rica Real Estate Market
While it can feel like bureaucracy, these measures strengthen the real estate market, especially in foreign investment destinations: With less exposure to illicit funds, more confidence among reputable investors, and fewer deals that damage local communities and reputations. Professional escrow companies in Costa Rica and Latin America now spend a significant part of their time staying on top of regulatory changes and aligning with banks, attorneys, and regulators so transactions can flow smoothly while still being compliant.
Escrow Protects Your Privacy in Cross-Border Transactions
A professional escrow process ensures confidentiality in cross-border deals, addressing major concerns like who sees passports and financial statements. Separation: Parties upload sensitive documents to secure, separate folders, preventing automatic access by others. KYC Access: The escrow company retains required documents for regulatory compliance, sharing them with authorities only when legally mandated, not with other private parties. Clear Marking: Confidential fields and NDAs. This strict approach is vital for cross-border transactions, upholding KYC and AML rules even when parties do not meet in person.
What to Look for in an Escrow Partner for Costa Rica Luxury Real Estate
1. High Degree of Regulation and Formality
As it runs with the SUGEF and international standards, it will provide more formalities in operation. This makes it more reliable, especially in the case of high end and international customers.
2. Speed and Customer Service
Coordination among escrow services, real estate agents, banks, and lawyers will help the transaction move without any delay on avoidable matters.
3. Physical Presence On Site
Meets the agent in person and understands local regulations and nuances. Agents working with international clients could have an edge by using such an escrow service, which offers strong regulation alongside a human touch.

Best Practices for a Secure Escrow Transaction in Costa Rica
As Costa Rica and other Latin American destinations continue to grow as investment and coastal luxury lifestyle markets, professional escrow is becoming a core part of doing business "the right way."
Find a Regulated, Neutral Escrow Structure: Avoid wiring large sums of money directly when a professional, regulated alternative is readily available.
Expect and Prepare Documentation: Supply necessary paperwork to comply with standard requirements for a serious transaction, not a cause for concern.
Security Protocols: Ask detailed questions regarding cybersecurity measures, confidentiality policies, and the procedures used to verify banking and wire instructions.
Escrow protects your transactions and allows everyone involved to move forward with more confidence in a market that is still evolving but quickly becoming more formal, professional, and secure.
